Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Pear.Us Venue iOS application (the “App”). The App is provided by One Market Inc., doing business as Pear.Us (“Pear.Us,” “we,” “us,” or “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the App.
1. Who the App Is For
The App is intended for event organizers and their authorized staff, including door staff and check-in staff, who use the App on behalf of an event organizer to support event operations.
You may use the App only if you are authorized by the applicable event organizer to act on its behalf for event operations. By using the App, you represent and warrant that you have such authority.
The App is not intended for general consumers. End customers do not create accounts or log in to the App.
2. Purpose of the App
The App is designed to support in-person event operations conducted on behalf of Pear.Us as the merchant of record. These operations include:
- Scanning and validating tickets that were pre-purchased through Pear.Us (for example, via QR codes)
- Searching guest lists and checking in attendees (for example, when a guest does not have a QR code)
- Selling tickets or event-related items to walk-in customers and accepting in-person payments, including Tap to Pay on iPhone transactions where supported
All in-person sales processed through the App are conducted under Pear.Us’s merchant account.
3. Staff IDs and Access Codes
To use the App, you must enter a Staff ID and an Access Code provided by the event organizer.
- Staff IDs and Access Codes are generated and managed by event organizers through Pear.Us web-based event management tools
- Each Staff ID identifies an authorized staff member
- Each Access Code grants access to a specific event
- You may only use Staff IDs and Access Codes as authorized by the event organizer
- You are responsible for safeguarding Staff IDs and Access Codes and preventing unauthorized use
Pear.Us may revoke or disable Staff IDs or Access Codes at any time in cases of misuse, unauthorized access, or security concerns.
4. Core App Features
After entering a valid Staff ID and Access Code, the App loads the corresponding event page and allows you to use the following workflows:
- Scan QR codes and verify tickets
- Search guests or customer names
- Sell at-the-door tickets or event items to walk-in customers
You may log out of one event and enter a different Access Code to access another event.
5. Event Expiration and Logout
Events in the App are time-bound.
- When an event ends, access to that event expires
- When an event has expired, the App will no longer permit access to that event and may automatically sign the user out of the expired event session
6. Ticketing and Payments
For tickets and event-related items sold through the App, Pear.Us acts as the merchant of record.
Payments are processed through third-party providers, including Stripe, Inc. (“Stripe”), including through Stripe Terminal and Apple’s Tap to Pay on iPhone technology where supported. Payment credentials are processed directly by Stripe and/or Apple and are not stored by Pear.Us in the App.
Funds from transactions are processed under Pear.Us’s Stripe account. Pear.Us calculates applicable fees and distributes net payouts to the event organizer associated with the event in accordance with Pear.Us platform agreements.
Pear.Us may receive limited transaction and order information (such as payment status, transaction identifiers, and order details) for recordkeeping, accounting, payout calculation, dispute handling, fraud prevention, and compliance purposes.
Payments are subject to the terms, conditions, and technical limitations of third-party payment providers.
Pear.Us is not responsible for payment failures, declines, delays, or interruptions caused by third-party payment providers, network interruptions, device limitations, or factors outside Pear.Us’s reasonable control.
7. Data and Privacy
The App displays limited customer and transaction information necessary for event operations.
- On-device purchase history and check-in information are removed from the App when the event ends
- Transaction and order records are added to the event organizer’s Pear.Us account and may be accessed by the organizer through Pear.Us website tools
- Transaction and order records are retained only for legitimate business purposes, such as accounting, dispute handling, fraud prevention, and legal or regulatory compliance
Your use of the App is also subject to the Pear.Us Privacy Policy, which describes how Pear.Us collects, uses, stores, and discloses information in connection with the App and related services.
8. Acceptable Use
You agree that you will not:
- Use the App for any unlawful, fraudulent, or unauthorized purpose
- Attempt to bypass ticket validation, check-in controls, or payment processing
- Share or misuse Access Codes without authorization
- Reverse engineer, decompile, or attempt to extract source code from the App
- Interfere with the App’s security, integrity, or normal operation
- Use the App in violation of any event organizer policies communicated to you
You are responsible for your actions while using the App on behalf of an event organizer.
9. Suspension and Termination
Pear.Us may suspend, restrict, or terminate your access to the App at any time, with or without notice, if:
- You violate these Terms
- Your use of the App poses a security or legal risk
- Such action is necessary to protect Pear.Us, event organizers, or users
10. Intellectual Property
The App and all related content, features, and functionality are owned by Pear.Us or its licensors and are protected by intellectual property and other applicable laws.
Except as expressly permitted by law, you may not copy, modify, distribute, sell, lease, or create derivative works from the App.
11. Limitation of Liability
To the maximum extent permitted by law, Pear.Us will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data, arising out of or related to your use of the App.
Pear.Us’s total liability for any claim arising out of or relating to the App or these Terms will not exceed the greater of:
- (a) the amount paid by the event organizer to Pear.Us in connection with the applicable event during the twelve (12) months preceding the claim, or
- (b) USD $100
12. Disclaimer of Warranties
The App is provided on an “AS IS” and “AS AVAILABLE” basis.
To the maximum extent permitted by law, Pear.Us disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Pear.Us does not guarantee that the App will be uninterrupted, error-free, or available at all times.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any disputes arising from or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in Santa Clara County, California.
14. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date indicates when changes were made.
Your continued use of the App after updated Terms become effective constitutes acceptance of the updated Terms.
